Refund Policy

Information on refund methods, timelines and other terms & conditions for items and/or services purchased on hecta.co

This document outlines the refund policy for the Transaction Support Services offered by Hecta Proptech Private Limited “Hecta” . It specifies the conditions under which refunds may be requested, as well as the corresponding service fees and deductions.

Refund Conditions:

1. Cancellation by the User:

  • Within 1 Working Day of Order Placement:
    • If the user cancels the request for services within 1 Working Day of placing the order, no deductions will be made, and the entire amount will be refunded.

  • After 1 Working Day of Order Placement:
    • If the user cancels the request after 1 working day of order placement, Hecta will deduct the applicable service fees based on the plan selected, as follows:

      • Free Plan: No service fees apply as this plan is free.
      • Premium Plan: INR 5,000 will be deducted as service fees, and the remaining amount will be refunded.
      • CERSAI Report: No deductions, full refund.
      • Borrower Profile: No deductions, full refund.
      • Valuation Report: No deductions, full refund.
      • Visit Assistance: No deductions, full refund.
      • Lending Application Assistance: INR 1,000 will be deducted as service fees, and the remaining amount will be refunded if the cancellation occurs before the loan application process begins.
      • Registration Assistance: INR 1,000 will be deducted as service fees, and the remaining amount will be refunded if the cancellation occurs before the registration process begins.
      • Encumbrance Certificate: No deductions, full refund.
      • Electricity Dues, Water Dues, and Property Tax: No deductions, full refund.
      • Certified Copies of Sale Deed: No deductions, full refund.

2. Failure to Deliver Services by Hecta:

  • If Hecta is unable to deliver the requested services due to reasons within its control, a full refund will be issued to the user without any deductions.
3. Auction Outcome – User Loses the Auction:

  • If the user participates in an auction for the property and loses, the applicable service fees will be deducted based on the plan selected (as outlined above), and the remaining amount will be refunded.
4. Best Effort Clause:

  • The services provided by Hecta are on a best-effort basis. Since the successful delivery of services is contingent upon support from respective authorities (such as regulatory bodies, government offices, etc.), Hecta does not guarantee specific outcomes or timelines. Users acknowledge this limitation, and Hecta shall not be liable for delays or failures caused by external factors beyond its control.
5. Disclaimer:

  • After receiving the order, Hecta will take 1 working day to review and accept the order. If Hecta does not accept the order for any reason, the full amount will be refunded to the user.

Additional Safeguards:

1. Confidentiality Clause:

  • All personal and financial information shared by the user in connection with the services will be treated as confidential and will not be disclosed to any third party except as necessary to fulfill the service or as required by law. Users also agree that any information provided by Hecta during the service delivery shall not be shared with any third party, nor used to initiate legal action against Hecta, the seller institutions, or the borrower.

2. Exclusions from Refund:

  • The refund policy does not apply to situations where the service is disrupted or delayed due to reasons beyond Hecta’s control, including but not limited to:
    • Delays or lack of cooperation from third-party authorities (e.g., government departments, regulatory bodies).
    • Inaccurate or incomplete information provided by the respective authorities.
    • Any force majeure event, such as natural disasters, strikes, or other external conditions affecting service delivery.
    • Any services where part or full delivery has already occurred before the refund request.
3. Termination of Services:

  • Hecta reserves the right to terminate services if:
    • The requested services are not available in the city for which the user has requested assistance.
    • Local authorities in certain cities are not willing or able to work with Hecta to provide the required support.
    • Termination notices will be provided promptly, and any applicable refunds will be processed according to the conditions above.

Refund Process:

  • Once the refund request is approved, the amount will be credited to the user's original payment method within 7-10 business days.
  • Refund requests must be submitted through Hecta’s customer service portal or by contacting care@hecta.co with the subject line "Refund Request."

Important Notes:

  • Non-Refundable Fees: Service fees are non-refundable once the cancellation falls outside the 24-hour window or if the services have already been partially or fully delivered.
  • Partial Delivery: If part of the service has been delivered before a refund request, deductions for those delivered services will be made in addition to the service fees.

Legal Safeguard:

  • Users acknowledge and agree that Hecta’s services are based on external dependencies, such as government or regulatory authorities. Hecta is not liable for any delays, non-performance, or failures caused by these third parties. Any legal claims must be based on gross negligence or failure to exert reasonable efforts, and Hecta’s liability is limited as per the agreements with the user, including indemnification and limitation of liabilities.
